These Terms of Use ("Terms") govern your use of Aftermath Engine ("the service"), operated by an independent developer (a sole proprietor) trading as Dustfall Studios ("we", "us", "I"). By creating an account or using the service, you agree to these Terms.
This document is written in plain language, alongside the Privacy Policy, to describe the actual relationship between you and the service. If anything is unclear, contact dustfallstudios@gmail.com.
You must be at least 18 years old to create an account or use the service. By using it, you confirm that you are 18 or older.
The service is intended for tabletop RPG game masters and is not directed at children. Please do not create accounts for, or upload content primarily concerning, anyone under 18.
You are responsible for the accuracy of the information you provide and for safeguarding your password. You agree to notify us promptly if you suspect unauthorized access to your account.
You may not share your account or use someone else's account. One account per person.
We may suspend or terminate accounts that violate these Terms, attempt to disrupt the service, abuse third-party providers we rely on, or upload content that violates the rules below.
You can upload session recordings or transcripts from your tabletop games, generate briefs and player reports, and use the resulting material however you like for your own games. Your campaign content stays yours (see Section 5).

If you upload content that includes other people's voices or contributions (such as recordings of your players), you confirm that you have made those people aware that the session is being recorded and processed by this service. The responsibility for that lies with you, not with us.
You retain full ownership of the content you upload (session audio, transcripts, briefs, campaign notes, NPC records, and so on). We do not claim any ownership over your campaign material.
To operate the service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the service to you. This license ends when you delete the content or your account.
We do not use your campaign content to train our own models. We do not sell your content. We do not display advertising.
The third-party providers we use (OpenAI for transcription, Anthropic for analysis) process your content under their own terms. See the Privacy Policy for details.
Some features of the service require a paid subscription. Payment is handled by Stripe; we do not see or store your full payment details.
Refunds: Your first paid subscription is refundable within 7 days of the initial purchase if you are not satisfied. After that, subscription renewals are non-refundable, but you may cancel at any time. Cancellation stops future charges; access to paid features continues until the end of the billing period you have already paid for.
To request a refund of your initial purchase within the 7-day window, or to cancel, contact dustfallstudios@gmail.com or use the account management tools in the service.
Pricing and tier features may change. If they change in a way that affects your existing subscription, we will notify you before the next renewal so you can decide whether to continue.
The service is provided as-is. We work to keep it running reliably, but we do not guarantee uninterrupted availability. The service depends on third-party providers (Railway for hosting, OpenAI for transcription, Anthropic for analysis), and outages or changes in those providers may affect availability.
We may add, change, or remove features at any time. If a change significantly reduces functionality that paid users are relying on, we will provide reasonable notice.
The service uses AI to process session content and generate briefs and recaps. AI output is not always accurate. You are responsible for reviewing what the service produces before relying on it or sharing it with your players. We make no guarantee that briefs or reports will be free of errors, omissions, or misinterpretations.
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, Dustfall Studios is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or in connection with your use of the service.
In any case, our total liability to you for any claims arising out of or relating to the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.
Some jurisdictions do not allow these limitations, so they may not apply to you in full.
You agree to indemnify and hold harmless Dustfall Studios from any claims, damages, or costs arising out of your use of the service, your violation of these Terms, or your violation of the rights of any third party, including the people whose voices or contributions appear in content you upload.
You may stop using the service at any time and delete your account and content yourself.
We may suspend or terminate your account if you violate these Terms, if continued service to you exposes us to legal risk, or if we discontinue the service. If we terminate your account for reasons other than your violation of these Terms, we will provide reasonable notice and offer a pro-rated refund of any unused portion of a current paid subscription.
Sections that by their nature should survive termination (ownership, disclaimers, liability limits, indemnification, governing law) survive termination.
These Terms are governed by the laws of the State of Idaho, USA, without regard to its conflict-of-law provisions. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Idaho, and you consent to the personal jurisdiction of those courts.

If we change these Terms in a material way, we will update the date at the top and, where appropriate, notify account holders. Continued use of the service after a change means you accept the updated Terms.
